Terms of Service

Effective Date: March 30, 2026

1. Acceptance of Terms

By accessing the website at blackstonemediamarketing.com or by engaging the services of Blackstone Media Marketing ("the Agency"), you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

2. Scope of Services

The Agency provides digital marketing services, including but not limited to:

• Lead generation and high-ticket client acquisition.

• Ad campaign management (Meta, Google, etc.).

• Appointment setting and CRM management.

Specific deliverables, performance guarantees (such as the "30 booked appointments within 90 days" program), and individual project timelines will be outlined in a separate Client Service Agreement or Statement of Work (SOW).

3. Client Obligations

To ensure the success of marketing campaigns, the Client agrees to:

• Provide necessary access to advertising accounts (e.g., Facebook Business Manager).

• Respond to lead inquiries and booked appointments in a timely manner.

• Provide accurate business information and creative assets when requested.

4. Fees and Payments

• Retainers: Monthly service fees are due on the first day of each billing cycle.

• Performance Fees: Any appointment-based or performance-based commissions will be invoiced as agreed upon in the Client's specific contract.

• Ad Spend: The Client is responsible for paying advertising platforms (Meta, Google) directly for ad spend. The Agency’s service fee is separate from ad spend.

5. Intellectual Property

All marketing strategies, custom ad copy, and proprietary workflows developed by the Agency remain the intellectual property of Blackstone Media Marketing unless otherwise transferred in writing. The Client retains ownership of their brand assets and customer data. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Limitation of Liability

Blackstone Media Marketing shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our services. While we strive for the highest results, marketing performance can be influenced by market conditions outside of the Agency's control.

7. Termination

Either party may terminate the service agreement with a [30-day] written notice, subject to the terms of the specific Client Service Agreement signed at the start of the engagement.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which the Agency operates, without regard to its conflict of law provisions.
